Terms of service

www.omae.mu - Version dated 26 October 2026

1. Seller

The website www.omae.mu (the "Website") is operated by OMAE SIGNATURE LTD, a company incorporated in Mauritius operating the OMAE brand, Unit 18, Building B, Domaine de Labourdonnais, Quartier des Serres, Mapou 31803, Mauritius - BRN C25219151 - info@omae.mu - +230 5250 9754 - Director: Chloé Vogelweid-Beretti ("OMAE", "we").

2. Scope

These Terms and Conditions of Sale ("Terms") apply to all sales made on the Website between OMAE and any individual acting for personal purposes (the "Customer"), whatever the Customer's country of residence. They are available at all times on the Website, can be saved and printed, and must be accepted before placing an order.

The Terms applicable are those in force on the date of the order. They are available in English and French; both versions have equal value.

Nothing in these Terms deprives the Customer of the rights granted by the mandatory consumer protection rules of their country of residence. Where a clause conflicts with those rules, it does not apply to that Customer and the more protective rule applies.

3. Capacity

The Customer confirms being at least 18 years old and legally able to enter into a contract, or acting with the consent of a legal guardian.

4. Products

OMAE sells yoga and Pilates activewear, swimwear and accessories (mats, blocks, straps, caps). Key features, composition, sizes and care instructions are shown on each product page and in the size guide. Photos are as accurate as possible; slight colour variations may occur depending on screens.

Products are offered while stocks last. If a product is unavailable after the order, the Customer is informed and refunded the corresponding amount without delay.

Use advice: yoga and Pilates are practised under the practitioner's own responsibility; if in doubt about their health, the Customer should consult a doctor. Mats must be used on a clean, dry surface and cared for according to the instructions provided.

5. Prices and currencies

Prices are displayed in Mauritian rupees (MUR) and euros (EUR). The Customer chooses the currency before payment and is charged in that currency, at the price displayed, without any conversion by OMAE. The Customer's bank may apply its own exchange or card fees.

Prices are final. As OMAE SIGNATURE LTD is not VAT registered in Mauritius, no Mauritian VAT is charged. Delivery costs are shown before the order is confirmed.

For deliveries outside Mauritius, customs duties, import VAT or local taxes (for example import VAT in the European Union or dock dues in Reunion Island) may be charged by the authorities of the destination country or by the carrier. They are not included in the price and are payable by the Customer unless stated otherwise at checkout. The Customer is informed of this before payment.

In case of an obvious pricing error, OMAE informs the Customer, who may choose between cancellation with a full refund or confirmation of the order at the correct price.

6. Order and formation of the contract

The Customer selects products, reviews the order summary (products, quantities, total price, delivery costs, currency, address), corrects any errors, accepts the Terms and confirms by clicking the "Order with obligation to pay" button or equivalent.

The contract is formed when the Customer receives the order confirmation e-mail, which sets out the order details and these Terms. OMAE archives the order and invoice, which the Customer may access on request.

OMAE may refuse or cancel an order in case of non-payment, fraud or attempted fraud, or a previous dispute with the Customer; any amount paid is then refunded.

7. Payment

Accepted payment methods: Visa and Mastercard (debit and credit) and Juice by MCB. Payments are processed securely by MIPS and the payment gateway of The Mauritius Commercial Bank Ltd (MCB), with 3D Secure authentication. OMAE never has access to and does not store card details.

Payment is taken when the order is placed. Before opening a dispute with their bank, the Customer is invited to contact OMAE so that a solution can be found quickly.

8. Retention of title and transfer of risk

Products remain the property of OMAE until the price is paid in full. Risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer (other than the carrier offered by OMAE), takes physical possession of the products.

9. Delivery

Delivery areas, times and costs are set out in the Delivery Policy and shown before payment. Unless another time is stated at checkout, OMAE delivers no later than 30 days after the contract is formed. Failing this, the Customer may, after requesting delivery within a reasonable additional period, cancel the order and receive a full refund.

The Customer checks the parcel on receipt and reports any damage or missing item to OMAE as soon as possible, if possible within 48 hours, with photos. This helps the claim with the carrier; it does not reduce the Customer's legal rights.

10. Right of withdrawal (14 days)

The Customer has 14 days from receipt of the products to withdraw from the contract without giving any reason. OMAE grants this right to all its customers, whatever their country.

To exercise it, the Customer informs OMAE of the decision by a clear statement (e-mail to info@omae.mu) or using the withdrawal form in the appendix, before the period expires. The Customer then sends the products back to OMAE - Returns, Unit 18, Building B, Domaine de Labourdonnais, Quartier des Serres, Mapou 31803, Mauritius no later than 14 days after communicating the decision. Return costs are paid by the Customer, except for defective products or an error by OMAE.

OMAE refunds all payments received, including the initial delivery costs (based on the cheapest standard delivery offered), no later than 14 days after being informed of the withdrawal. OMAE may withhold the refund until the products are received or proof of return is provided. The refund is made using the same payment method and in the same currency as the original order, at no cost to the Customer.

The Customer may try the products as in a shop. The Customer is liable for any diminished value resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (products worn, washed, damaged, tags removed); OMAE may then deduct that amount.

Legal exceptions: the right of withdrawal does not apply to personalised or made-to-measure products, nor to sealed goods unsealed after delivery that cannot be returned for hygiene reasons (swimwear bottoms with the hygiene liner removed).

11. Legal guarantees

All products benefit from the legal guarantee of conformity and the guarantee against hidden defects provided by the law applicable to the Customer. For consumers residing in the European Union, the guarantee of conformity lasts at least 2 years from delivery. For consumers residing in Mauritius, the guarantees under Mauritian consumer protection law apply.

In case of a lack of conformity, the Customer contacts OMAE at info@omae.mu describing the defect (photos). Depending on the case and as provided by law, OMAE repairs, replaces or refunds the product and pays the return costs.

12. Liability

OMAE is not liable for damage resulting from use contrary to the use advice, improper care or normal wear and tear, nor for non-performance due to force majeure (including cyclones, natural disasters, strikes, transport disruptions). Nothing in these Terms excludes or limits OMAE's liability where the law does not allow it, in particular for gross negligence, personal injury or the legal guarantees.

13. Gift cards and offers

Gift cards are valid for 12 months from purchase, unless a longer period is required by the Customer's law, and cannot be exchanged for cash. Promotional offers cannot be combined unless stated otherwise and are valid subject to their conditions.

14. Intellectual property

All elements of the Website (texts, photos, logos, designs, the OMAE brand) are the exclusive property of OMAE SIGNATURE LTD. Any reproduction or use without prior written authorisation is prohibited.

15. Personal data

The processing of the Customer's data is described in the Privacy and Cookie Policy.

16. Customer service, complaints and mediation

For any question or complaint: info@omae.mu - +230 5250 9754. OMAE undertakes to reply within 5 business days.

In case of dispute, the Customer and OMAE will first seek an amicable solution. Failing that, the Customer may use, free of charge, a consumer mediator or the consumer protection authority of their country of residence (in Mauritius, the consumer protection service of the Ministry of Commerce).

17. Governing law and jurisdiction

These Terms are governed by the laws of Mauritius. This choice does not deprive the consumer of the protection of the mandatory provisions of the law of their country of habitual residence. The consumer may bring proceedings before the courts of Mauritius or of their place of residence; OMAE may bring proceedings against the consumer only before the courts of the consumer's place of residence where the law so requires.
